These Survey Publisher Terms & Conditions (“Publisher Terms”) govern the creation, publication, and distribution of Surveys on the Dastavez.net platform. They form part of the Terms of Service and apply together with the Acceptable Use Policy, the Value Coins & Rewards Terms, the Data Processing Addendum, and the Privacy Policy.

1. Introduction and Acceptance

1.1  These Survey Publisher Terms & Conditions (“Publisher Terms”) govern the creation, publication, and distribution of Surveys on the Dastavez.net platform. They form part of the Terms of Service of DASTAVEZ.NET (SMC-PRIVATE) LIMITED (“Dastavez”) and apply together with the Acceptable Use Policy, the Value Coins & Rewards Terms, the Data Processing Addendum (“DPA”), and the Privacy Policy. Capitalised terms have the meanings given in those documents. In matters of Survey publication, these Publisher Terms prevail over the Terms of Service; in matters of Personal Data processing, the DPA prevails.

1.2  By clicking “I Agree”, publishing a Survey, or using the survey-publishing features, you (“Publisher”, “you”) accept these Publisher Terms. If you do not agree, do not publish Surveys.

1.3  These Publisher Terms supersede all prior versions of Dastavez’s Survey Publisher Terms & Conditions.

2. Role of the Platform

2.1  Dastavez provides technology to create, distribute, and analyse Surveys. Dastavez does not design Survey questions, control Survey content, select or supply Respondents, or verify the accuracy, legality, or ethical compliance of Surveys. You alone are the Survey Publisher; Dastavez acts solely as a technology service provider and, for Personal Data collected through your Surveys, as your Processor under the DPA.

2.2  Dastavez does not guarantee response rates, response quality, respondent demographics, completion rates, or research outcomes. Respondent quality-integrity measures (Rewards Terms Section 6) are applied on a commercially reasonable efforts basis and do not shift responsibility for research validity to Dastavez.

3. Publisher Responsibilities

You are solely responsible for every Survey you create, publish, or distribute, including:

  • the content, wording, structure, purpose, and intent of Survey questions and any screening criteria;
  • compliance with all laws applicable to you, your organisation, your Survey subject matter, and the locations of your intended Respondents — including data protection, consumer protection, market-research, electoral, health-research, and sector-specific rules;
  • ensuring Surveys are not misleading, deceptive, discriminatory, abusive, or unlawful, and do not infringe third-party rights;
  • the accuracy of any claims, disclosures, or incentives you present to Respondents; and
  • your team members’ use of Publisher seats, whose actions are attributed to you.

4. Data Protection — You Are the Controller

4.1  For Personal Data collected through your Surveys, you are the Data Controller and Dastavez is your Data Processor under the DPA, which applies automatically and is legally binding on both parties.

4.2  As Controller, you must, before publishing a Survey that collects Personal Data:

  • identify a lawful basis for the collection and each intended use, under every data protection law applicable to your Respondents (including GDPR/UK GDPR, US state laws, and Pakistani law, as applicable);
  • provide Respondents with the transparency information required by applicable law — at minimum, your identity and contact details, the purposes of collection, how responses will be used and shared, retention, and how Respondents may exercise their rights against you;
  • configure Survey settings (anonymity, identifiability, retention) consistently with what you tell Respondents; and
  • where you rely on consent, ensure it is freely given, specific, informed, and unambiguous, and keep records of it.

4.3  Acting for a client. If you publish Surveys on behalf of another organisation, you warrant that you are duly authorised, that the controller’s obligations above are met by you or your client, and that you may lawfully appoint Dastavez as (sub-)processor; Module Three of the SCCs applies as set out in the DPA.

4.4  Rights requests and incidents. You are responsible for responding to Respondent rights requests concerning your Surveys; Dastavez will forward requests it receives and provide the assistance described in the DPA. You must notify Dastavez promptly at privacy@dastavez.net of any suspected Personal Data Breach involving your use of the Platform.

5. Informed Participation and Research Ethics

Every Survey must be conducted ethically. Before or at the start of participation, Respondents must be clearly informed of:

  • the purpose of the Survey and who is conducting it;
  • how their responses will be used, shared, and retained;
  • that participation is voluntary, and that they may decline or stop at any time without penalty (beyond not earning the participation reward);
  • whether responses are anonymous or identifiable, and any conditions affecting that status; and
  • any rewards or incentives, described accurately in accordance with Section 7.

Deceptive research designs (including undisclosed purposes or simulated scenarios presented as real) are permitted only where a recognised ethical framework applicable to you allows them, appropriate debriefing is provided, and no law is violated. Selling, fundraising, lead generation, advertising, or political persuasion disguised as research is prohibited (Acceptable Use Policy Section 4).

6. Sensitive Data and Minors

6.1  You must not collect special categories of Personal Data (including health, religious, political, sexual-orientation, or biometric data) or other highly sensitive data through Surveys unless: (a) you have a valid lawful basis and any explicit consent required; (b) the collection is expressly and prominently disclosed; and (c) you apply heightened security and minimisation. You must never solicit passwords, full payment-card numbers, banking credentials, one-time codes, or government identifiers, except that lawful collection of a government identifier expressly required for a disclosed, legitimate purpose must be pre-approved by Dastavez in writing.

6.2  You must not direct Surveys at individuals under sixteen (16) (or a higher local age of digital consent) without legally valid parental or guardian consent, and you must not attach Value Coin rewards to Surveys directed at minors. Age screening must be configured where your Survey design or distribution makes participation by minors reasonably likely.

7. Rewards and Incentives

7.1  Rewards you offer must be funded by Minted Value Coins (or your Starter Pack) in accordance with the Value Coins & Rewards Terms and the Pricing Schedule, and must be accurately described to Respondents at the point of participation — the amount (or the rules that determine it), any conditions or quality standards, and any tiering.

7.2  You must not describe rewards as cash or as an obligation of Dastavez, promise redemption values or timelines that depend on the Redemption Partner, or impose undisclosed conditions after responses are submitted. Once a Value Coin is distributed under your disclosed rules, you may not reclaim it except through Dastavez’s integrity process where fraud or breach is established (Rewards Terms Section 5.3).

7.3  Dastavez may modify, limit, or revoke platform-based rewards in cases of abuse or manipulation, and does not guarantee participation levels driven by incentives.

8. Prohibited Surveys

The prohibitions in Section 4 of the Acceptable Use Policy apply to all Surveys, including bans on phishing and credential harvesting, unlawful or undisclosed data collection, targeting minors without valid consent, disguised selling or persuasion, disinformation, and content promoting hate, violence, or illegal activity. Dastavez may remove or suspend Surveys that violate these requirements, following the enforcement and review standards in Sections 6 of the Acceptable Use Policy and 8.6 of the Terms of Service.

9. Ownership and Licence

9.1  You retain ownership of your Survey content and, as between you and Dastavez, of the response data collected through your Surveys. You grant Dastavez the limited licence described in Section 9.2 of the Terms of Service, solely to operate, secure, and improve the Platform. Dastavez does not sell your Survey data and does not use identifiable Survey responses for its own purposes except as permitted by the DPA (including aggregated or anonymised service analytics that do not identify Respondents or reveal your confidential research).

10. Suspension, Removal, and Export

10.1  Dastavez may suspend or remove Surveys, restrict publishing privileges, or terminate Publisher accounts where a Survey or your conduct violates these Publisher Terms, the Terms of Service, the Acceptable Use Policy, or applicable law, or poses legal, security, or ethical risk — applying the proportionality, reasons, and review standards referenced in Section 8. On termination not involving fraud or unlawful use, the thirty (30) day data-export window in Section 17.4 of the Terms of Service applies.

11. Indemnification and Liability

11.1  You will indemnify, defend, and hold harmless Dastavez, its directors, officers, employees, and affiliates from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your Surveys, your processing of Respondent data as Controller, your violation of law or third-party rights, or disputes between you and Respondents — subject to Section 15.2 of the Terms of Service where you are a consumer.

11.2  The survey-publishing tools are provided “as is” and “as available”. Sections 13, 14, and 16 of the Terms of Service (Disclaimers, Limitation of Liability, Consumer Rights) apply to these Publisher Terms.

12. Governing Law and Contact

12.1  These Publisher Terms are governed by, and disputes resolved in accordance with, Sections 16 and 19 of the Terms of Service.
